Would Bristol and West have sent me my title deeds?

Not sure if this is the right place for this query but it has come up because I am selling my house. My solicitor is unable to locate my title deeds and thinks B&W sent them to me and that I have them. I am fairly certain that they didn't - I don't think I would have "forgotten" something like that. I know the deeds are replaceable but there were other documents with them that are not so easily replaced. Does anyone here have a mortgage with B&W and no deeds in their possession - or has anyone been sent deeds (and if so, when)? I've had my house for 4 and a half years.

I have a mortgage with BandW also and i do not have deeds from them. I have actually asked my solicitor as to whether i am entitled to my deeds at this moment in time. i should point out that i am not in your position: i am not selling my house but simply asked my solicitor whether i was entitled to them. i get conflicting advice/views on the forum regarding this.BLOODBATH IN THE EVENING THEN? :shocked: OR PERHAPS THE AFTERNOON? OR THE MORNING? OH, FORGET THIS MALARKEY!

I thought that the solicitor keeps the deeds in their archive, well ours did for the last two house purchases.0

Ours were sent to us by the Staffordshire (AKA Portman/Nationwide) some years ago. I still have them in a box under the bed!
Is your house registered with the Land Registry, because apparently the Land Certificate is all they need. Staffordshire said we could throw the historical deeds away if we didn't want to keep them.(AKA HRH_MUngo)

Deeds are kept by building society /bank if you have a mortgage if you do not have a mortgage then you should have possession of them. Banks/building societies hold onto them in case you default etc on mortgage so they can then sell your property etc. When you sell you house the solicitor will request them from bank etc in readiness to pass them to the new owner or onto the new owners mortgage company. So if you have mortgage which it sounds like no you should not have them and no the b/s would or should not have sent them to you

This is not necessarily correct. If your house is registered at the Land Registry, the historical deeds are of no longer of any legal value (although they may make interesting reading). The Land Registry holds all the information.
This is what the Staffordshire told us when they sent us our deeds, I'm pretty sure we still had a mortgage at the time.(AKA HRH_MUngo)

I expected B&W to have them, but was told by my solicitor that I should have them as banks/building societies no longer keep deeds. B&W have told my solicitor that they don't have them, what is not clear to me is whether B&W are saying that they sent them to me (I need to phone them about it, I guess) or whether they just threw them away. It's not the deeds I am concerned about, it's the damp proof guarantee and some other indemnity policies that I do not have copies of. If B&W did throw them away, is there any chance that they are in any way liable for the additional expense I am going to incur replacing the policies and guarantees? Also, is there any chance they could have sent them back to the solicitor I used when I bought the house? (Again, I need to personally contact these people, but the great thing about forums is you can find out other people's experiences and thus be a bit more informed!)0

i remortgaged through Bristol & West (previously with different mortgage co) earlier in the year and they sent me the title deeds

The phyical deeds are not necessarily needed.
In most cases they will be stored electronically at the land registry.
I have 4 properties only 1 of which is mortgage free yet I have all the deeds in my possession.
Some lenders, recognising there is no need to keep them, send them to you as a matter of course (and to save them money)dolce vita's stock reply templates
#1. The people that run these "sell your house and rent back" companies are generally lying thieves and are best avoided
#2. This time next year house prices in general will be lower than they are now

I had a problem lately, having been sent my deeds I couldnt find them (we are selling).
Our building society no longer retains deeds and also sends them out as a matter of course.
Our Solicitor was able to very quickly get hold of them from the Land Registry, they got all the info that the require for the sale with no fuss at all.
