Final Reminder Notice

A Parking Charge Notice was issued in respect of my company van, for allegedly breaching the terms and conditions of use of the Privately Operated Access Roads in Wakefield. The alleged contravention was detected and recorded by Mobile Traffic Enforcement Cameras (CCTV) at the siteand the reason for the contravention was: Stopping on a roadway where stopping is prohibited.

I hadn't been working for my employers very long when they sent me to Wakefield. My SatNav took me down this particular road twice before I stopped to re-enter the postcode only for SatNav to take me down same road again.I also stopped to make a telephone call to one of my colleagues to ask for further directions. I don't know which one of the "stops" has been recorded, but I now my emplyer has given me this Final Reminder Notice telling me not to ignore this notice and telling me I have to pay £100.

My employer gave the PPC only part of my name and my postcode and they received this Final Notice and passed it on to me telling me to sort it out.

Please help.

    OK, so read the NEWBIES thread first and respond the the PCN yourself but as lessee/hirer (NOT saying who was driving).

    Which parking firm? It makes a difference.

    But read the NEWBIES FAQS thread anyway, to find the sort of appeal to use without giving away the driver. Your company can't have named you as 'driver' because they were not there. You are the hirer/lessee of the van.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Thanks for reply, had already read that thread and copied and pasted the IPC member reply, just needed to be sure I was doing the right thing.

  • So, I've received a letter from Vehicle Control Services Ltd. basically saying the points in my appeal are not appropriate and I have until 22nd December to pay £60 fine, non payment will see that figure jump to £100.

    Should I post the full letter in here so I can get the best advise?

    your boss needs to reply to the parking Co , on company headed paper and state that he has passed the notice to the driver , however due to DPA he cannot tell them who was driving

    VCS do not use the protection of freedom act , so they can only legally go after the driver , not the van owner .

    to adhere with the POFa they have to allow a grace period , say 10 mins , which they have not

    To adhere with the POFA you must allow a grace period, which judging by your picture evidence you have not.

    I don't think that POFA says anything about a 10 minute Grace period. However, the BPA/IAS do and that is what you should be saying. In fact, it has to come from your boss.

    You wrote "My employer gave the PPC only part of my name and my postcode and they received this Final Notice and passed it on to me telling me to sort it out." Can the PPC find you from the Electoral roll? If so, and with the previous info given by your boss, they could try court anyway.
