Parking Charge Notice Conundrum, requesting advice please.

Hi all
and thanks for this brilliant forum!
My wife, this morning, received a PCN with a charge of £60 or £100 depending on when paid.
The PCN was because of a 24 minute overstay!
I've scoured this site and found loads of information but am now suffering from information overload.
The PCN was issued on 28/11/2016 and was sent to her as the car's registered keeper.
Obviously the car park company, Premier Park Ltd, have no idea whether she or I was driving the car.
I'm really after guidance as to what order to do things in.
I've already complained to the manager of the major retail store, who are the major tennants of the landowner, and he said he'd email Premier Park Ltd as we are very regular customers. He said it'd probably be a couple of days before we hear anything.
Assuming the email approach doesn't work, could you please advise me as to the next avenue for me to go down.
Many, many thanks in advance,

Bleriant

  • In the intervening period, you need to compare the PCN to POFA2012 Schedule 4 and make sure that they haven't missed any info from it.

Also check the dates to make sure it was received within the mandated periods.

If you don't hear back from the manager, then keep on at him. Don't trust that he'll do the right thing without being pestered.

Just in case, you need to avail yourself of the template letters on the **NEWBIES** thread. These can be sent off at any point within the allowed appeal period. Make sure you pick the right one depending on which body you're dealing with - either the BPA or the IPC.
  • Thanks for the prompt response Carthesis.
    I've looked at POFA 2012 Schedule 4 ............................. wow!
They don't like to make it easy, do they?
Why don't they keep it simple for simple people?
In the mean time, I've sent off my appeal to Prem Park Ltd, but I'm not expecting much joy.
I'll keep you all posted as to my progress.
    Maybe I'll leave POFA 2012 Schedule 4 as a last resort .

    Yours,

    Bleriant.

Schedule 4 is really easy to read, plain English. Bullet points.

And Premier Park do not comply, as you will find simply by searching this board for 'Premier Park'. Trouble is, POPLA get it wrong.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

  • ............. and this is how it finished.
The manager of the retail store called me after a few days to say that he'd emailed Premier Park and they emailed back to say that they would cancel the ticket!!!
A few days later I got an email confirmation to that effect from Premier Park.
For me the were two key elements.
    1. This fabulous forum .................... so, thank you very much.
    2. Complaining to the store manager in a friendly and polite manner.
Once again, this forum was the major factor. So many people would just 'suck it up' and pay the fine.
    Again, many, many thanks :T.

Nice one, great result. Send a 'Thank You' card to the manager, which will encourage him to help others similarly.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
