Ukcps notice - summer 2016

Hello all,

I've read the newbies post and can't understand how it relates to my case so would appreciate some help.

I received a notice on the windscreen some months ago after parking off the public road on private land.

It was a huge empty area with no indication the road had become private land and it was after 7pm with no road markings so I thought I was doing the right thing.

I asked my dad what to do that day (who had experience with these around 2012) and he said to ignore.

Other notices have arrived since (which I ignored) and obviously they've kept coming and so today I've done some research and see that UKCPS will take some to court and even issue CCJ's now unlike a few years ago.

As I haven't appealed within the 28 and 56 day windows through the first appeals procedure as instructed on the newbie thread what should I do for best results?

Happy to get any simple advice on how to try and stop these letters or what to do. I'd hate to get a CCJ. I've never had any debt apart from a mortgage my whole life so feel it would be unfair.

If it helps, I took pics on the day of my car and the lack of signage anywhere near my car. Indeed it was only after finding the 'fine' on my window I looked around and saw a sign a long way away, on a door the same colour that was illegible from the distance I was at.

Maybe this info helps with what I can do?

    That will not happen till they decide to stop.
    I'd hate to get a CCJ.
    Same as most people, then! Luckily we don;t expose people to that risk here. That will not happen, does not even happen when some people lose at a hearing. You only get a CCJ on your credit file if you don't pay within 30 days of a judgment, either after losing at a hearing AND THEN REFUSING TO PAY or after court papers are ignored.

    Not likely to happen, is it? Make sure you see each letter. Write to tell them if you move house within six years.

    your dads advice was very poor and maybe he should be held "responsible" ?

    tell him from me not to give out any more legal advice about parking

    as for the letters, there is nothing you can do to stop them , not unless you paid in full (which we dont advise)

    UK CPS have 6 years to bring a court case against you , and they do try a few hundred every year

    if you lost and paid what the judge says (the judgment) within 28 days then the matter is settled and no CCJ is issued

    its non-payment of the judgment that results in a CCJ (effectively "contempt of court")

    so if you lost , pay it quickly and thats the end of it

    "bargepole" says to take enough cash and pay the court on the way out , and get a receipt , if you lost , then its over with

    if it goes past 6 years , its statute barred from the court process
