Starting a claim where the amount keeps building...

First, I should note that this if for an account which I no longer actively use for any of my financial stuff - all switched to another account when I started the first claim.

I am almost there with my first claim to get my charges back (6 years worth), but of course this is for the charges to a fixed date and since that date the bank have continued to charge, taking the account overdrawn and therefore incurring more penalties.

The entire balance of the account is about £400 overdrawn, all (or pretty much) is made up from charges and as the process of claiming (exclusing the test case scenario and 'stays') is likely to take 6+ months, there will be yet more charges applied to the account.

Can someone advise as to, how I word a claim against the bank that will sort it or how I can stop them adding more charges whilst I claim ... I think that you get the drift.
We missed out on the reclaim of nearly £5000 bank charges from HSBC, but picked up over £10000 in PPI claims against them instead. I am now debt free and working to help my other half clear hers

  • the banks wont stop charging you, start claiming and wait into this OFT is over then u will get it back
  • Yeah, but the snag is that I claim for the current balance of say £400 and by the time that it get's through to being paid - say 6 months - the bank have added a further £25 per month, plus interest, which makes the balance up to £550.

    Actually, as the bank have written to me asking how I intend to repay the balance, I guess that I could write back to them saying that I have no intention of repaying the amount requested, as it represents illegally deducted money, based on the same bumpf as the original claims.

    It seems to be taken for granted that the banks will lose and everyone will get all their charges back in their entirety. Perhaps it would be a good idea to have a contingency plan in case this doesn't happen.

    yea try that, the more they charge the more u will get back in the end.
    but it wont go well on your credit score
  • To be honest, it's all money that I thought that I never had. If the test case comes through and I lose the £400, so be it. My first claim is signed/sealed by the judge (well almost) so I doubt that they can appeal against that and even if they could, I doubt that they would - due to the amount of claims it would involve.

    I would have assumed that any entries that they make against the credit scoring, you can have reversed as part of the result at the end. I wonder if anyone has done this and how you go about it.
