Charge backs and bank mistakes

Options
I need some advice regarding an incident I've had with my bank. Few months back I have reported a fraudulent transaction. I requested for that one transaction to be investigated and cancelled. Bank instead cancelled all the transactions I have made on that day including those I have been paying regularly each month. I called to to get it sorted however they were not very helpful but eventually we got to the bottom of the issue. Eventually all the charges and payments have been processed but I have been left with the damaged credit score and being chased by debt collectors. I requested the bank to sort it all out, however they have refused and only offered me a monetary compensation.
I have opened a case with an Ombudsman's, who decided the bank did enough. Credit score still damaged and fee months down the line one of my creditors took another payment from my account saying that they have lost a charge back case with my bank. \i tried to query it, but they keep telling me that I need to speak to the bank, who never put the money in my account. I have send a proof that all has been settled, but they are not interested insisting I should contact the bank.
Can any one suggest whats the best way forward with it and recommend no win no fee solicitor ?

First of all yes your credit score was hit but obly you can see your score, no 1 else can see it. What counts is the history is all correct.

You say you requested the bank to sort it, was it over the phone or in writing ?

I'm not sure where chargebacks come into things.

However, you didn't pay your bills (possibly due to bank error) but you made no subsequent attempt to pay them manually by cash/cheque/debit card or Faster Payment...were you expecting Santa Claus or the Toothfairy to fulfil those missed payments?

Please list the payments that were debited to your account that day?
Did you have enough cleared funds to pay them?
Were they returned as a direct result of your call or bounced?
  • I've paid all my creditors separately couple days later when realised that transactions have been cancelled by the bank, but they still recorded it as I've queried those payments and one of them straight away referred it to debt collectors although the payment was settled separately. I even send them a letter from the bank admitting to the error.
Charges were cancelled a result of my call to fraud department to look into one transaction on that day because it wasn't one I've made.
  • That would be lovely but no, I've paid it directly couple days later.
  • I requested over the phone when spoke to manager who was sorting the mess with my account \(they only operate via phone) and than later on in writing when case was looked at by the Ombudsman's office
  • Your issue with debt collectors is nothing to do with the bank, I would not expect a creditor to go down that route for one missed payment, especially as you settled the payment in a couple of days.

You need to sort that out with your creditor directly, and once you have done that ditch your relationship with them ASAP.

If the Ombudsman has decided the bank did nothing wrong, i wouldnt bother with a solicitor. The best way forward is to speak to your bank again.
  • Am I not wrong in believing that if the situation ever occurs, you're responsible for sorting it out then the bank reimburse you any charges as a result of there mistake and compensate you accordingly for wasting your time? I'm fortunate enough to have not got myself into this situation, but my understanding is the above; is this not the case?

A couple of days later and they sent it to debt collectors...
Did it reach the Supreme Court by the end of the week too?
