VCS (IPC) PCN & Company vehicle

Unfortunately I fell victim to the scam artists VCS when I pulled up on a "No Stopping/ Waiting" zone at Calder Park. The picture of my vehicle was taken by ANPR International who hilariously pulled up on double yellows to take my picture (I have a picture of their van pulled up taking a picture of my van :rotfl:)...

I am happy to appeal using the template set out for IPC appeals in the stickys newbie thread, however, the PCN has been handed to me by my boss who is not happy about me appealing in the first place ("it affects my business") and who has said that if the initial appeal doesn't work then she will take money out my wages to pay it (she wins boss of the year :T)

My question therefore is how successful is the initial letter? I can't imagine VCS are just going to roll over. When my boss inevitably receives the 'appeal rejected' letter she will just deduct from my wages. I note in the thread it states:

"If the hire/lease co gets a postal PCN and names you as the driver/hirer, that is a good thing as it removes them from the loop entirely and then you can follow the above advice as appropriate to your case..."

Should I therefore get my boss to fill out the form and name me as the driver in the first instance and then appeal using the template when the PCN is sent to my address?

    Your boss appears to be an idiot.

    No, do not get them to name you as driver, get them to name you as lessee/hirer and state that this discharges their liability under the POFA 2012.

    There is another post on here now about the same thing with the precise wording to use.

    Yep look at Bluecat115's thread which is on this page, not far away. Be named as HIRER/LESSEE and that discharges the company liability completely (not that they can be held liable by VCS, but it doesn't sound like your boss understands that).

  • I'm puzzled as to why your boss would think that this speculative invoice could affect her business - at least she's alerted you to the PCN rather than just paying it (though I doubt that your contract of employment would allow her to deduct payment of this or any speculative invoice from your wages).

    Does the company own the vehicle outright or is it a lease vehicle?

    I have had a look at Bluecats post and will get the PCN filled out today and get my boss to squiggle.
    Not sure if she'll go along with a headed letter but we shall see when I ask her and explain it discharges company liability....

    I need terms of the vehicle being a lease/owned. I'm not entirely sure but I imagine they are owned. I work for a company owned by British Gas. The PCN came straight to my boss whereas if it was a lease it would have gone to the hire company wouldn't it?

  • In the case of a leased vehicle, VCS would first send a PCN as a Notice to Keeper to the lease company. The lease company would then contact VCS to alert them to the fact that the vehicle in question was on hire, passing on the hirer's details. VCS would then reissue the PCN to the hirer.

    VCS use the same (non-POFA compliant) wording on their Notices to Keeper and Notices to Hirer. The best clue as to whether your van was leased or owned will be the gap between the respective "Date of Contravention" and "Date of Issue" stated on the PCN. If the gap is more than 15 days, it's likely that the van is leased.
  • There was only 1 weeks gap from date I was at Calder Park to the date the invoice was received so the vehicle will be owned.
    I'll see what she says when I'm back in the office tomorrow and I'll keep you updated.

    In the meantime we have placed the Parking Charge Notice on hold. However, if we do not receive the requested information by the supplied date we will continue to pursue this notice at the applicable charge."

    I hadn't actually written my name on the form, I had just written hirer/keeper and supplied my address. Should I ask my boss to write back and give them my name?

    Yes you should have asked your boss to put the hirer's name on the letter/form.

    Either get her to write back naming you as hirer (NOT DRIVER), or you do it yourself in her name (with her permission.)

    Of course they needed your name as well as address...get that resubmitted by the company (do not 'name the driver' though).
