Ok, it's a bit clearer now I think.

For clarity, we're not trying to wriggle out of out obligations, we merely felt that the proposal was well over-pitched for what we required. If indeed we are forced to maintain the agreement then we will have to bite down and take it.

The problem is that you sound like you are trying to wriggle out of it.

If it was 'over-pitched' and was more then the company required, then they should have stated this at the time, instead of going ahead and paying for the past 7 months.

Sounds just like buyers remorse, only that its come to light since you joined the company.

I am curious to know what happened to your financial manager though! I'd never get away with erroneously paying a third party from a company bank account for 7 whole months! Probably gross misconduct, and if they are registered to a professional body then they would run the risk of being struck off!

So, if nothing has happened to your FM then I'm inclined to think that either:

    1. Your company/finance department is awful (get out of there! Lest you perhaps not receive your wages one month!)

    2. You are trying to wriggle out of it with an excuse that it was an error (gotta be careful when you attach blame to someone when it is untrue! Especially when you can be traced online)

I commend your loyalty to your company though. This is, I imagine, one for your FM to resolve and not you....?

You are in a legally binding contract, agreeing with the proposal and paying for the last 7 months clearly shows this. Signatures on paper are just one of many ways to form contracts.

They say they are waiting for your input now, if you disagree then you could try for breach of contract for them not doing any work on it. At this point yes you are in a legal contract but can you prove a breach of this contract? A solicitor is your only option but that could cost more than the last 17 months of the contract.
