Underwear bought online

I wonder if you can help? I bought underwear online, and am trying to cancel the order. I can see without opening the packages that this is not what I wanted. I contacted the seller (U.K. Company) who said at first that all products were unrefundable. They have finally accepted a return, as long as the packaging is unioened, which it is, but they have been so difficult that I suspect they will find s way to reject it once they receive it.
What are my rights in returning underwear bought online? I can't find any direct links to the legislation. Does it fall under goods that by their nature cannot be returned?!
Their website also says it charges a 25% restocking fee. I'm pretty sure they can't do that, but what are my rights to reclaim it if they charge?

It falls under the CCR regulation of goods that once opened lose up to 100% of their value. Underwear would lose 100% of their value if they were opened, would you buy underwear returned by a customer?
In your case however if the packaging is still sealed then they can make no deduction, the 25% restocking fee is illegal too, you should also get your original postage back.
There are other terms they need to stick to such as giving you all the relevant information regarding your CCR rights in durable means but if you want to know what that entails google them.
There are still websites that don't want to play ball because the CCR's are simply unfair on retailers, especially small businesses who foot the bill for postage and packaging every time someone changes their mind.
How do you make them? well that's what the courts are for.0 -

You have every right to return the goods.
There is no exemption for underwear.
I cannot find anything in the legislation that mentions 'goods that by their nature cannot be returned'.
The legislation being The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
They cannot charge a restocking fee.
See Regulation 34 paragraph(8)
Make sure you return the goods by a tracked method.

It's fit britches. There's quite a few problems with their website ts and cs, which I'll point out to them once they've processed my refund.
I just suspect they'll point out some problem which means they can't give me a refund. They'll probably claim they've been opened, which they haven't, but not sure how I'll prove that. I've taken pictures of the sealed packets before I returned them, but it's not the sort of packaging that is obvious once it's been opened. There's no hygiene seal or anything.0 -
