County Court Claim, please help !

I recieved a pcn back in April from Minster Baywatch. At the time I had an annual parking permit from my employer and was parked in the car park. I used the holder they provided (a sort of tax disc holder) that wasn't particularly reliable and it fell of quite a few times.

Anyway, I was using my friend's parents car that hadn't been signed over yet. I actually received two different parking tickets, one was sent to them and they paid up before I could talk to them. The other is one this post is about.

I (stupidly) messaged them to tell them I was using the car at the time and didn't make an appeal. I never thought it would get this far. I have done AoS and I intend to defend the claim.

Can I use the fact I had a permit as a defence?

    Can I use the fact I had a permit as a defence?

  • Hi I contacted the employer at the time and they weren't interested. The best they could do was reduce the ticket to £30 instead of £60. They are now claiming £150 ! I don't see why I should of paid anything when I paid £60 for an annual permit.

    Thanks I did have a look through but I couldn't find a case like mine so thank you for helping me find it!
  • Hi I have looked at your example and it seems to be quite different. In that defence it is stated that (paraphrasing) they are not bound by the contract as they didn't have a permit and they weren't 'parking' when they were unloaded. I had an official permit which I paid for it just wasn't displayed at the time ! I just don't even know where to start with my defence!

    Yes you do know where to start. Right here. You only have to search the forum for 'permit defence' to find dozens more.

    You will by now have read the NEWBIES thread and you will have seen some more defences there, plus bargepole's post about what to do when. You have surely submitted the AoS and over the weekend you can start copying from someone else's defence wording, you will see a pattern when you read several.
