Retired headmaster gets PCN for merely driving around private car park

Courtesy of Euro Car Parks and the muppet pays up! I guess he doesn't know about MSE, then.

Apparently he'd been driving around the car park for 11 minutes, but couldn't find a space that he was happy with so drove straight out again and ECP nailed him for it. Shameful.

Note how the Yahoo article stupidly calls it a fine rather than correctly a parking charge notice, which we know are very different animals. Kwality journalism there, Yahoo.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    What possessed him to pay??

But his story contains an anomaly:

The headline says he didn't "even park" but he admits after driving round for 11 minutes he stopped "briefly" (most would call that parking) then decided to move to another car park as he didn't want to use the stairs he had discovered there!

Not really parking, now we have a persuasive definition at last. Charles Harris QC didn't call that parking, in the Jopson case. That's an example of a mere 'vicissitude' which excuses a short stop. As the wife was disabled, looking for a non-potholed space was reasonable.

    Paying it was idiotic.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Oh well, at least I get to read another version of this story. :) I see the Mail are also calling it a fine. More kwality journalism there.

On top of that, you should see the tons of bad advice being given in the comments under the Yahoo article. I pity anyone who follows it.
