Private Parking Ticket Letter Before Referral Legal Action

Cutting a long story short got a ticket from euro car parks demanding £80 for overstaying 2 mins in a car park in Scotland which frankly was ridiculous given there was a perfectly good reason why. I did not reply as i am very busy and had a lot.going on work.etc so the letters from DR+ rolled in and filed them away making no contact with them and again refusing to pay. Had no letter for almost a year and 3 months but got another today saying letter befor legal action again demanding 140 may be court proceedings etc etc. Couple of things i take it advice scotland same being driver is responsible etc and 2 how long can these agents send out these letters the level of harassment for a 2 min overstay quite frankly is shocking and bordeing on harssmemt/torture sure thats prohibited by article 3 echr!!! Any replies appreciated

As long as the driver's identity is never revealed, Scottish motorists should always ignore anything and everything they get from a private parking company and their capitalist running dog debt collectors.

There is no keeper liability in Scotland, so stay in ignore mode. The ticket becomes statute barred after 5 years in Scotland, six years in England.

Always complain to the landowner as keeper and tell them to get the ticket cancelled.

  • Thanks fruitcake I thought as much. I realise I could maybe have tried to resolve it last year but people have their lives to get on with dont see why i should go through the stress and time yo appeal for 2 mins when the location where alleged offence happend receives the amount of the fine on a weekly basis from me. Little visit to the manager tomorrow i think

If you haven't got a lot of time, then ignoring is perfectly OK in Scotland (and NI, but not in England or Wales). Anything else you do goes towards educating others, including landowners, what an utter scam the unregulated parking industry is.

Telling a retailer you are never shopping in their store again because of the parking scammers they employ may have no effect on its own, but when sales start to fall, or the time taken to deal with so many complaints rises, they may just take notice.
