    2. POPLA and appeal process for Railway Land
    There is a meeting on 27th January 2017 to discuss this issues. John Gallagher decided to
    make a decision on the outstanding cases as they could not stay adjourned, he concluded
    that he would allow them all. He has invited the Operators to withdraw them and will allow
    the rest. He is meeting with with the DVLA, DCLG and the Railway Operators on the 27
    January 2017 to agree the process including the appeals.
    If you park in a railway car park it will be a criminal case and they will allow clamping, which
    does not seem good practice.
    One possibility is the DVLA to say that operators can continue to use POPLA but this means all
    appeals will be dismissed. Currently they are bound by the decision where the appellant is
    not. The alternative will be to take POPLA out of the equation and then it is pursued through
    the criminal system

    Looking on the POPLA site, the reason for this is:

    Withdrawal reasons

    The signage at the location had the wrong telephone number displayed.

    Anyone else who gets a ticket from Indigo, fight it, YOU WILL WIN!

    I found it amazing that even though I appealed to POPLA they still continued to chase me for the money and send me threatening letters....
  • Closely linked ... I've just heard back on initial appeal to Indigo against a parking notice at Watford Junction. I also appealed using same approach and grounds as above (visibility of signage) and they (Indigo) have accepted the appeal.

    Didn't get as far as POPLA, interesting and brilliant!!

    NO , they knew it would cost them £27 to be told to cancel

    but how many people simply pay up?

    POPLA and the BPA simply did not go far enough , they should have told members that they simply could not issue tickets

    report INDIGO to the BPA at aos@britishparking.co.uk , with unredacted copies of all paperwork , especially the debt colelctor letters etc whilst it was with popla

    its a BPA CoP breach to chase an apellant whilst their appeal is with popla

    and if they got your details from the dvla, you may want to think about a counter claim due to a possible DPA breach , but you would have to check with the dvla and the ICO first

    I agree - grounds to claim for data misuse as there was no reasonable cause to get keeper data when the case was already appealed and at POPLA, a stage where the BPA CoP requires that no work is carried out on a PCN.

    But firstly find out from the DVLA by email, who accessed your data as keeper and when. And then complain to the ICO about it, then use that upheld complaint as evidence to claim £250 or more from Indigo.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Good afternoon!

    I have contacted the DVLA ans I have the following information:

    I appealed to POPLA on 17 Jan 2017.

    Indigo contacted the DVLA for my details on the 23/01/2017 for "breach of terms and conditipons of a private car park"

    So am I right I should now contact the ICO about this?
    I went though and ICO says "have you contacted the company about this, should I contact Indigo about this or just click yes?"

    I'm not 100% sure on the wording for the ICO but I can't find a template letter. Short of " Indigo contacted the DVLA while I was still appealing an then has released it to ANOTHER company to chase a debt which was was cancelled and they had no reasonal cause to request my information" I'm not sure what else I need to write..
