Seller sent me wrong DVD and has relisted my DVD Should I buy it again?

Hi there a very prominent seller of DVDs on Ebay
Their user name consists of an indication that they are a very large "global" if you like, book seller.
Anyway, I ordered a season 1 box set DVD
They sent me instead a film -that I have already, but the sales slip was included with the DVD and said that it should be the season 1 that I had ordered.
The seller has re-listed my "Season 1" 30pence more expensive with a different item No.....
I have sent an email (tonight) asking for it to be resolved.
Questions...
1) Should I buy the re-listed item, NOW, to stop it from becoming a problem with another ebayer buying it.... And then the seller not having it to give to me... If I buy it NOW again, then we can cancel the sale when it all gets sorted out?
2) Do you think they will ask me to return the film, that is not worth very much? (£3.50 free postage is the current rate on ebay). If I was the seller I would tell me to keep the wrong film as compensation and say I will resend the one I ordered.
I paid £3.66 for my season 1

Why not just return and get the correct DVD sent out.0

Just open a case for not as described and return for a full refund. Exchanges are very difficult on Ebay, it is easier just to ask the buyer to return for a full refund.
If you are sure no-one else is selling it (and at that price there probably is) then you can buy it again but you need to treat it as a different transaction to the first one and pay for it before you get your money back for the incorrect one.0 -

If I did as y'all suggest, open a case and return it. Would I get the return postage costs refunded aswell?
Anyway I emailed them last night and there has been no response today.

If you open a case for not as described then you will get a pre-paid returns label so it will not cost you a penny. If the seller did an exchange (which is unlikely) they will most likely wait for you to return the incorrect DVD, which could be days.
If you really want this DVD you need to buy it and then sort out the incorrect one. Although personally I'd see if someone else had it. If they send out incorrect DVDs and then ignore messages, I would not want to deal with them again.0
