I take it, it was purchased from a second hand shop such as CEX or similar. In this case you would have seen the products you were buying. Breach of contract will be hard to prove in this case unless you can shed some light on why you think you have a case.

Well yes, in this day and age if my daughter forgets to take out her mobile phone you would think her world was about to come to an end. I some times think it's been surgically implanted to her hand, and the funny thing is I don't think she has ever made a call from it.
