    yes.
and you obviously have internet access so not at all difficult to find guidance on buying a car. It's no secret re finance and HPI checking! It's basic common knowledge.
AND Autotrader themselves provide obvious in your face guidance.

I'm pretty sure that innocent buyer thing is when you buy from dealers. Doesn't count with private purchases

    You're wrong.

It applies to private buyers too.

Does this mean am not covered by the innocent purchaser law? What do i do now as i cannot find the seller to get my money back.

You may have been an innocent buyer, but the item may have not been the seller's to exchange for monies, where was the vehicle advertised?
The cycnical part of me suggests it was a bit too convenient that the seller was going abroad and you happen to be paying cash.

Who was the registered keeper on the V5?

I guess the loan was secured against the car and he has stopped paying the HP?

How else would Black Horse know he had sold the car?

From the thread title, I'd guess it was advertised on AutoTrader.

If you are an "innocent purchaser" ("a purchaser of the motor vehicle in good faith without notice of the hire-purchase or conditional sale agreement") then you would get to keep the car without any obligation to the finance company. The difficulty you may have is if the finance company do not believe that you are in such a position, which can then lead to the finance company taking you to court, with the court to pass judgement.

    You need a solicitor.

Get an HPI check done first, to see what the deal is with finance.

The Man i bought it from was the registered keeper as his name and actually address was on the logbook, but looking at the logbook the car has 3 previous owner plus me making it 4 now. but he told me he also bought the car second hand when i asked him if he had it from new and said as i can see from the logbook there are previous owners...

Sorry, I don't think you'll get more than that; maybe you'll get that there's outstanding finance and Black Horse has an interest in it, but you know that already.
