Pay & Display PCN

Hi All,

Need some advice please. I parked on a Pay & Display car park. Purchased a ticket and displayed it on my dashboard. I then collected my baby from the back seat and went about my business. I came back to my car being ticketed and the ticket I had displayed had fallen out of view! I have since written to the company explaining what had happened and that it must have blown out of view when collecting my baby. I also sent pictures of the valid ticket I had purchased. They have since replied saying they are unable to cancel the PCN.
Is it worth doing a further appeal as it is so close to Christmas and I don't have £60/£100 to simply hand over :( Thanks

You won't be paying this though. By now we assume you have read 'NEWBIES PLEASE READ THESE FAQS FIRST'.

Which parking firm and have they offered POPLA? Is it ParkingEye?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Which parking company issued the ticket?

Are they a BPA member and have they issued a POPLA code when they rejected your initial appeal?

Have you told them who was driving?

If the PPC is a BPA member, then it is worth appealing to PoPLA. If they are IPC members then it is probably not worth appealing. It is a shame you told your story and thus probably gave away the driver's details.

You may find the following encouraging.

    From the Parking-Prankster's blogspot,

    http://parking-prankster.blogspot.co.uk/2016/11/gladstones-pick-link-parkings-pocket.html

where a judge said it was the parking company's fault that the ticket blew over.

Gladstones pick Link Parking's pocket twice. Claim dismissed for upside down ticket

    C8GF30W7 Link Parking v Mr H. !14/11/2016 Port Talbot!

Mr H parked and purchased a valid ticket which he displayed on the dashboard. When he returned to his car he found a parking charge because at some time the ticket had turned upside down. This was the second hearing. The first was adjourned.

The judge dismissed the claim. He ruled that it was the responsibility of the parking company to provide sticky backed tickets and that he had already thrown out 6-10 of these type of cases which Link Parking had brought

You may find this information useful to quote back to the PPC, especially if they are a BPA member and you appeal to PoPLA.

In view of Link Parking v Mr H (C8GF30W7) they would probably struggle in court.

Bring this case to their attention and challenge them to take it to court, where you will be seeking costs for unreasonable behaviour.
You never know how far you can go until you go too far.
