Retrospective payment for breaking lease

Hi all, just looking for some advice on this situation.


My partner was living with a friend for a period of time then we decided to move into together. They had contacted the letting agent to inform them that she would be moving out but her friend would remain, so she would take over the lease. My partner was the main tenant but her friend was named on the lease too.


This was all done and the new lease signed on 1/10/16. My partner has recently received an email from said letting agents asking for a £50 charge for breaking the lease. I know the time frame is probably irrelevant but surely they should have chased this quicker? Does she have to pay this, what action can they take if she just ignores it?

    Breaking the lease in what way?

  • In the sense that the lease ran until say March, but she broke it in September, then her house mate took it over.


    We're going to check what her lease says in the terms and conditions, for some unknown reason this had slipped our minds lol

    It doesn't make sense you see, you cant charge a penalty like that, but if it's £50 to set up a new tenancy, that is allowed.


    Which is why it's important to know exactly what theyre charging for

    1) not sure what that 1st sentence means. Was she named as a joint tenant, or as a Permitted Occupier?

    2) if the lease describes under what circumstances, and at what cost, the lease can be ended early, then that is what can be charged.

    If it does not, then it is normal for it to be negotiated/agreed when the early surrender is discussed /agreed. A fee cannot be randomly invented and charged later.

    3) yes the timeframe is irrelevant. Debts can be pursued for up to 7 years.
