Scottish divorce query

Hi

7 years ago my partner and his wife separated.
She had and still does suffer from mental health problems. She brought the separation on irreconcilable differences ? The separation went to books of council where all financial matters are sorted first. She kept the council house and he was effectively homeless. We got together shortly afterwards and now have a young family. Earlier this year we decided to get married but we were not sure if the divorce had ever been finalised. To find out we asked his step daughter. The divorce was never finalised.
So how do we go about obtaining a divorce now..do we need a solicitor and any idea of cost?
We do know she hasn't taken the idea of us getting married well and has stated she won't give him a divorce and If she gets any letters she is off to see her solicitor to counter claim? She will get legal aid due to benefits we are just about managing! Please help and advise..we just want to get married. Thanks
