Suggest you listen to Pixie and Tbagpuss for the legal grounding.

Sicard, Cashewnut and pphilips are unfortunately is totally off the mark

(cant be bothered to type out the same advice as above)
  • Thanks for the advice.Help is greatly appreciated when your world is crashing all around you.
  • Too late for the OP but a little info for others who may be getting themselves into this position. A few years ago I moved into my brothers house as he moved to NZ and while he was away we decided that we would pay off the mortgage with me contributing 25%. With us being siblings we certainly don't envisage ever falling out but we did go to a solicitor to get something in writing which cost us around £200. It didn't get my name put on as a part owner of the house which was fine with me, it was just a guarantee that if he ever wanted to sell up I was legally entitled to 25% of the sale price. Was pretty straightforward and gives everyone peace of mind should the worst happen.

Is she a reasonable person? Ask for the lump sum back.

Other than that, I assume you would have been paying rent somewhere if you weren't living with her so the fact you paid half the mortgage each month and now want equity seems greedy to me.

You do not know how much 1/2 the mogage payment was,it could be double or treble what they would have paid in rent or lived with a parent/sibling/mate/ for free. What they should have done was had their name added to the deeds as this could happen 20years down the line when the property/morgae was paid off.

Thanks for your reply - though I'm not sure I made myself clear I have paid half the mortgage every month since I moved in over 3 years ago. I also gave my girlfriend a lump sum to pay off the mortgage ... I am to loose my home and my lump sum savings that are tied up in her mortgage....is there no hope for me?

How much was paid off in the 3 years? How much did the house increase or decrease in value in those 3 years?
