Hi everyone I'm struggling to get help getting my agency fees or some of my agency fees back.
I have recently split with my ex partner and needed a place to rent suitable to have my daughter at the weekends. I found the perfect spot and took it as soon as I viewed.
I knew I had some bad credit in the past as I had been turned down by an estate agent before and needed a guarantor. I informed the estate agent of this and she told me it would be fine with a guarantor or the rent upfront. I offered 6months rent upfront which also including utilities for a 6 month tenancy. I was then put on the phone to someone to make payment and fill out an over the phone application. The golden question then came up do you have any CCDs that you know of. I answered not that I know of but I do have bad credit and have been turned down before but I will be paying six months upfront. She informed me that this would be fitness I'm paying up front but still go through with checks. The property was taken off the market and all was going well. One week later I get a call o the agent saying I have failed the credit check and they keep my money and I don't get the house!
I don't understand how I can be turned down for bad credit when I'm not asking for any credit all bills and rent are being paid upfront!
I also informed them that I have bad credit and have been refused else where. They argued that bad credit is different to a ccj
And my 3rd arguement was surely they only keep the credit check fee as the other 300 pounds says it covers inventory checks tenancy agreements and deposit handling. None of that is now being done. So surely I'm entitled to a partial refund at worst!?
Please if anyone can give me any advice on the matter or how I can go about getting my money back as the estate agents don't seem to care thanks

You can't.0 -
I didn't lie they asked do I know of any ccjs I said no ccjs that I know of but I have bad credit and have been refused by agent before and needed guarantor. This is not Lieing ?0
-
They also informed me that as I'm paying the full agreement upfront it shouldn't matter?0
-
But do you have CCJs?
The rest is largely irrelevant.
You can try MCOL and go to court, but as they said bad credit and CCJs are not quite the same thing
Or speak to the landlord direct0 -
Why is the other stuff irrelevant. They have turned down my application and kept my money as I have bad credit but I'm not asking for any credit as rent and all utilities are paid upfront therefore having a ccj is irreverent ? Maybe speaking directly to the landlord would help thanks.0

1: you didn't answer my question, so I assume you do have a CCJ. Is it still outstanding?, what is it for?
2: credit checks aren't to offer you credit, it's to see if you can afford the rent, and if you are a reliable payer.
3: you are renting for longer than 6 months. So they need to know going forwards you will pay0 -
Once the 6 month fixed term (pre-paid) is up you still have a right to stay in the property, at which point rent will be due.
So risk to the landlord is after the fixed term ends you don't pay any more rent and it takes a little while to get you out of the house. Having CCJs increases the risk for this to happen (in their eyes at least).
Could be it's the LL here who has said no (intially ok with up-front payment and bad credit, less happy when they found out about the CCJs) rather than agent recommending against it.
Might even be the LL has insurance for missing rent and won't pay out if the tenant has CCJs.0 -
1 yes I've been informed I have a ccj from around 3 years back and it most still be outstanding as I didn't even know I had it.
2/3 you said credit checks Are to see if your a reliable payer and can afford rent as originally stated its a six month tenancy including bills in the rent price. I offered all six month upfront! Hence why I'm slightly annoyed that I have failed on a credit check when I don't require any credit and rent and all bills are to be paid for the entire tenancy upfront0 -

Well there you go then.
The tenancy wouldn't end after the 6 months, that's why.0
