Resignation and Wage Raise

Hi,
I have a peculiar situation I'd like to ask advice on.
I resigned from my current job a couple of weeks ago but I offered to stay for longer than the regular notice period as we're on stupidly busy times which management and HR were thrilled with and I'm staying until mid January.
Now, an increase in pay was announced 2 months ago, they're calling it merit increase but EVERYONE is getting it and it's being paid out retro-actively counting from July and that will happen next Monday the 28th.
Am I entitled to receive this increase? Since I've been working here for 4 years and I had no intent of leaving until a couple of weeks ago plus I'm staying until AFTER this increase.
I'd like to know the legality of this because I have a feeling HR will try to not pay this to me with the excuse of people on notice period aren't entitled to that.
Many thanks
