VCS lose in court. Keeper not liable for driver's actions
C8DP70P3 VCS v Mr A. 23/11/2016 Birmingham Court

http://parking-prankster.blogspot.co.uk/2016/11/vcs-lose-in-court-keeper-not-liable-for.html

"BW Legal has a strategy of taking keepers to court when they know keeper liability does not apply and when they have been informed the keeper was not the driver."

This does not seem to be working out very well for them

NEXT PLEASE ......

This is all becoming highly amusing, the scam is being reversed and now the PPC is feeling the brunt of poor advice.

Maybe it's the turn of the PPC to complain to the SRA about the principals they apply and how they are being ignored

Not sure I share your optimism, BG. We hear of maybe a couple of cases a week going against PPCs, yet daily the county courts across E/W are dealing with dozens.

Today there are 27 cases. Most days it's a similar list. 12 months ago you'd be lucky to see 2 or 3 on a daily basis.

Unless you have better data on success rates?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Those 27 are not all involving BWLegal and that's what we are talking about on this thread.

As said previously to you, it is now the time period that the BWLegal cases kick in after their mail scam

  • I thought solicitors had a duty of care to their clients and that should not include pursuing hopeless legal arguments for financial gain.

Maybe their motto is ' If you don't try - you don't get' !

It's possible that these cases are to show that they are capable of flexing their muscles once in awhile, it's just a pity for them that they keep losing :rotfl:

Go back one click to the main page and click on the NEW THREAD button.

Alternatively go to Moneysavingexpert.com, forum, Motoring, then click on the sub-board title, Parking Tickets Fines and Parking, then click on the NEW THREAD button.

However, please read the Sticky thread for NEWBIES before you post.
