Insurnace claim not being progressed

Hello All. Hoping for some interesting options and feedback here:
December 2014 I was involved in a no fault accident. Someone drove into the back of my car while I was stationary. The other party’s insurance covered my car repairs eventually, but I had to take some time off work. I believed that my insurer would follow up on the compensation claim on my behalf, but once the car was sorted, as I did not have legal cover, all their involvement stopped. March 15, I found this out and followed up with the other party’s insurance and they said they would deal with my claim. Nothing happened for 4 months so I started to write to them and push. They sent back an offer which I didn’t accept as it hardly even covered my costs, and I included a calculation of my own. 3 months on, still no progress so I sent in a formal complaint. I got a call and was told it would be dealt with. 2 months on and still nothing. So I wrote another formal complaint. This complaint was properly investigated and considering the weight (20 emails) of evidence the complaint was upheld. I got a cheque for £100 for time and trouble. I was also assured that my claim would be dealt with. That was May 2016. I was advised that I needed to have a medical consult, to which I agreed, that was also May. I am still waiting! I complained to the Ombudsman, who investigated and replied saying that there was nothing they could do as I was not insured by the company in question. So, now I want to take the insurer to small claims court. I don’t think my claim is ridiculous, I used a logical calculation and it is only to recoup what I have lost, time off work and telephone costs.
Any thoughts or suggestions?
Thanks

If you cannot get anywhere with the insurer then court is your last resort. Best to get proper legal advice on this.
(You were misinformed that you should go to fos over your dispute.)0 -
Thats why i always take the legal cover option. 99.9% of the time its a waste of money until you need it and realise what a mistake it was not getting it.
They made you an offer that covered your losses and you refused it?
Pop up your claim and people will tell you whats OTT and whats acceptable.
May save you a wasted court date.Censorship Reigns Supreme in Troll City...0 -
Hi there.
Supporting evidence I have supplied to the Ins. comp.. Work attendance,
2012= 1 day sick.
2013= 1 day sick
2014= 4.5 days sick, 1 day Dr visit.
2015= 2 days sick, 1 day wasted time(OOO).
2016=1 day wasted time.(OOO)
I am not sickly, I don't take advantage of the system. I work in a pressured environment where time away from the office is not to be taken lightly. I have not made any claim for accident/compensation before.(mid 40's so I have been around for a while)
My calculation is below:
Half day off on morning of accident @ x per day( worked out at my daily rate)
Day off for Doctors @ x per day( worked out at my daily rate) (pain materialized 2 days after accident)
Four days off work @ x per day( worked out at my daily rate) (after DR visit)
Four days off work @ x per day( worked out at my daily rate) (between then (2 years) and now for pain, follow-up and cancelled consultant visits)
Phone bill (itemised).
