It may not be applicable now but for the next time why don't you think about putting the 'taking it off the market' as a condition of the bid?
I have used a variation of the following script twice before and both times the agent removed the listing as soon as I provided proof of funding, which was the same day, as I had the required information ready and available.
I would like to make an offer on property x. I have the funds in place and can share that information to you immediately following acceptance. I am ready to move quickly and if the seller wants a smooth transaction than I can offer them that.
Bearing that in mind I wish to make an offer of 'x' subject to the following conditions:
1 - All future viewings are cancelled
2 - The property is withdrawn from the open market immediately
3 - The sold board goes up within 48 hours
4 - I receive weekly updates on the progress of any activities from the vendor's point of view
Hope that helps. We’ve had to remove your signature. Please check the Forum Rules if you’re unsure why it’s been removed and, if still unsure, email forumteam@moneysavingexpert.com0 -
I find it highly unlikely that an EA would instigate an instance of gazumping, if only for the reason I mention above, it makes practically no financial difference whatsoever, and simply creates extra work. In most cases where gazumping occurs the blame should lie with the seller.
I can't say how the relationship was between the EA and the vendor who was in prison, but the one who wasn't banged-up wanted out asap, so the appearance of another party was just a distraction from her POV.
I guess it's more likely when both vendors aren't singing from the same hymn sheet!0
