Cancel childrens Martial arts Contact

My children started a martial arts class with 6 month supposed contract with the money going to Smartpay Uk. They are no longer interested in going anymore. I informed the class they wouldn't be attending anymore to which the class teacher said there is a 3 month cancellation notice. I can't find any info on the contract I signed stating any cancellation notice. Am I able to just cancel the direct debit without any problems. I've wrote some not all of the terms of agreement further down which hopefully someone can give me an idea wether I can leave or not

Terms of agreement with Smartpay Uk

Period of agreement
: this agreement will continue until, all the payments detailed on the front of this form have been satisfied. This agreement is a commitment to retain a member for the period stated on the front regardless of change in personal circumstances

Payment
: if you fail to pay the whole or any part of the monthly payment on time, we may charge interest on that sum at four percent above the banks base rate from the due date until, it is paid
: An administration fee of £10 will be added to the monthly payment due should your account fall into arrears and is settled within a month. A further £20 fee will be added to each subsequent monththereafter for accounts that remain in arrears

If you break this agreement
: if you break any term if this agreement and fail to comply with a default notice sent to you in respect of that breach, we may require you to pay us immediately the whole sum for the notice period together with any outstanding amounts

Cancellation
: This agreement can not be cancelled unless special provision is made under the special pro ions box on the front of this form
: Note that no refunds will be given where payments have been made and the student has not attended

    I think you'll be hard pushed to get a refund, you have already stated that you knew it was a 6 month membership & it says right there in your post that

    "this agreement will continue until, all the payments detailed on the front of this form have been satisfied. This agreement is a commitment to retain a member for the period stated on the front regardless of change in personal circumstances"

    Hi thanks for your reply it isn't a refund Im looking for its just to cancel it and make no future payments as my children won't be attending the class from this point forward

    If there's more than 3 months to pay for then I think you've been offered a good deal to only pay 3.
    If less than 3 then I think they're pushing their luck.

    A minimum term contract is just that, so you'll doubtless have to pay an Early Termination of Contract (ETC) fee in order to exit prior to the six months you agreed. ETCs are routinely almost the same cost as paying for the entire term, so be prepared.

    If you simply cancel the Direct Debit, you'll have debt collectors and ultimately a trashed credit file and CCJ to contend with. So don't.

    In future don't sign up for such long minimum terms, because children's needs (or desires) are often fickle.

    Hi Jimmy there are 4 payments left outstanding.

    one of the reasons I'm trying my best to get out of this contract is I feel my children have been treated unfairly which I something they feel too, they are in a basic programme at the martial arts school but they also offer a leadership programme my children are being overlooked and treated differently just because they are on a basic programme, coming home after each lesson with an upset child is heartbreaking.

    I understand if I am stuck within this contract I will have to pay it, I'm just trying my best to stop payment so my children would be able to join something else whe they would be a lot happier

    If there's more than 3 months to pay for then I think you've been offered a good deal to only pay 3.
    If less than 3 then I think they're pushing their luck.

    Thanks for the info I wasn't aware of the ETC

    Thanks I won't be cancelling the DD as I have worked hard to build the credit score I have now after some stupid decisions in my youth.

    The children were relatively happy until the teacher started treating them differently to the people in the other programme ( both programmes do the same class at the same time)

    Guess I'll have to just think of this as lesson learnt and unfortunately continue to pay.

    Just ensure you tell them that you will be terminating the contract at the end of the 6 month period. You don't want them rolling it forward again.
