If disclosure carries no financial penalty, then how can non-disclosure be fraud?
When you complete an insurance application you agree you have told the truth which usually includes disclosure of incidents and losses even if no claim was made.
It would be fraudulent were you to deliberately try to reduce the premium by making a false application.
No fault claims often do result in premium loading, but not immediately - they would be taken into account at the next policy renewal0 -

This says that if I report it, even though it's not my fault, my premium will almost certainly increase!!!! That's so unfair! What should I do?
It is unfair in some circumstances, but that said I know someone who has been rear ended at roundabouts no less that 7 times in the last 3 years. There has to be a contributing factor and therefore I can't argue with her insurance premiums going up.“I may not agree with you, but I will defend to the death your right to make an a** of yourself.”

The alternative would be to get a quote for the repairs, pass the quote to the person who hit you, requesting full payment. When you get the money, the matter is closed.
This obviously comes with risk that he claims for injury further down the line or your insurer finds out you lied and cancels your policy.0
