Unfair Bonus Assistance

Hi all.


Basically, is there anyone who can help me and my colleagues. We work a nightshift and are on 40pph more than the dayshift who do the same job, but for completing the same set KPIs the dayshift receive a 50pph bonus, whereas on nights we only receive a 30pph bonus. Senior management say that this is because of the difference in basic pay, but myself and my colleagues on nights believe this to be wrong to adjust the difference in pay in a performance related bonus basis, if they want to pay days the same amount, then they should adjust their basic, not the bonus.


I hope this makes sense. If someone can point me where I can look for more information/assistance then this would be greatly appreciated.

    Providing the employer pays either NLW or NMW (where appropriate) they are not contravening employment law.

    Exactly.

    Also, unless the discrimination is for one of the handful of reasons prohibited by law (gender, religion etc) there is no obligation to pay people doing the same job the same money. Similarly with a bonus (which are almost invariably "discretionary") an employer can pay different employees different amounts or none at all.
  • So nothing I can do about it, aside from trying to "win their hearts and minds" then.... hmmm. OK. It just seems blindingly unfair to almost penalise a nightshift for doing the same as the dayshift, but only for certain levels of staffing.


    To clarify, the rest of the shift ( line leaders, lead hand) get the same whichever shift they work on, only the supervisors get more on days than on nights...

    It comes down to supply and demand. If they can't get suitable people for certain shifts then they will have to up what is on offer. If they can there there is little incentive to pay more than the legal minimum.

    Even if your work did equalise the bonus they would be very unlikely to do it by increasing the night one - much more likely to increase the basic pay on days by up to 20pph and make both bonuses the same at 30pph.

  • but my argument is that if they want to equalise the basic rate, then they should do it that way, not by increasing the bonus to minimise the gap, when we all have the same targets to hit, that's what I don't like about it and what makes it unfair....

    So its fair you get 40pph more but not the 50pph bonus?

    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked
  • Do not the majority of shift based employers pay a nightshift premium of more than 4%? Now equal to 2%...
