Received a PCN from TCM what to do?

Hi all,

I received a PCN from TCM (Total Carpark Management Ltd) on Saturday night for parking incorrectly. I was there for no more than 5 mins collecting my dinner, this car park is a free car park too. So how they can justify the charge I don't know, they haven't lost anything by me parking where I did and I wasn't causing any issues for other drivers. Complete money making scam clearly.

What frustrated me the most if I arrived at my car just as the parking attendant did, I asked who he worked for and he lied told me he was council so I waiting for him to issue the tickets. Otherwise I would have drove off. I challenged him when I noticed the ticket was TCM and private he said were part of the council?! No your not, oh I thought we was.

They are members of IPC, how would I find out if they are banned from obtaining DVLA information?

What should I do first, I've read a few forums re what to do but I'm not 100% clear as this is not a POPLA route but IAS.

I've read to wait for the 26th day to appeal and not to ignore. Does 26 days inc non-working days?

If I receive a Notice to Keeper within this time what do I have to do?

When I send my initial appeal letter, and is is rejected what next? I've read not to bother appealing to IAS as they're pretty ruthless.

As much help as anyone can offer would be greatly appreciated, I have so much on my plate at the moment it's the last thing I need.

    Unfortunately you now have this on your plate no one will do it for you, and you will have to go through the motions.

    Your first lesson learned is that the private parking industry is full of liars.

    Now read the newbies thread on this forum and follow the help offered.
    When you said [STRIKE]you[/STRIKE] the driver parked incorrectly what do you mean?
    Out of bay?
    Over hatched area?

    They no longer need to justify the charge, they will try and scam you in any way they can but justifying the amount is no longer an appeal point unfortunately.
  • I'm prepared to fight it, I didn't realise my post came across that I wanted someone to do it for me.

    Well he said it was a hatched area but I could barely see the lines.

    I spent most of the day yesterday going through the threads but it wasn't very clear in some areas hence my questions in my first post re 26 days, how to find out if a company is banned from obtaining info from DVLA. I read a few things about PCC's not issuing a Notice to Keeper but what if I do receive one?

    I read there is no point in appealing to IAS so what happens when they reject my appeal? If they were POPLA I would have had an option to appeal to them, but they're not??

    I thought that there were companies out there who take care of these things for a small charge. Surely they have not all gone to the wall.
    You never know how far you can go until you go too far.

    you ask the DVLA if a PPC is banned from obtaining keeper data , especially yours, I thought that was obvious (but I doubt that this PPC is banned)

    day 0 is the day of the problem , day 26 is 26 days later , for IPC members its day 19 to arrive by day 21 , where the day 0 is the day of the parking incident (windscreen ticket) , so you read the wrong part as you read the BPA member advice and not the IPC member advice

    read the IAS advice if you want to know about further appeals, most people say dont bother with the IAS at all , including me as its not an independent ADR

    appeal any NTK as KEEPER if it arrives in the post, which should be between day 29 and day 56 following the incident (but may be longer) , it should never come before day 29 as they would be in breach if it did - definitely do this part if you dont bother appealing the driver ticket (if you actually receive an NTK)

    No, of course not. 26 days is 26 days - but check on the PCN in case 'appeals' are in fact required within 21 days (some IPC firms say this in which case send the IPC challenge about day 18).
    If I receive a Notice to Keeper within this time what do I have to do?
    That can't happen, the whole point of appealing a PCN before day 28 is to delay a PPC in dealing with the 'appeal' so they might well forget/overlook the NTK. Which they can't send anyway until 29 days have gone by.

    Hence the timing we recommend, to get in there first with a keeper appeal and distract them.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
