Good old parking eye ccj

Went and did one of the free credit checks about a month ago and discovered I had a ccj against me at an old address.

A call to the court on the Monday morning told me it was from a unpaid parking fine from Parking eye from Sept 2015. The address for the ccj was one which I had moved out of two years before that.

Now I wasn't sure but pretty certain the car wasn't registered there Sept last year so I paid my £255 and applied to have the ccj set aside .

I also wrote to the DVLA asking for the dates and addresses the car in question was registered at while I owned it….As I thought the car wasn't registered there at the date of the ticket but more interestingly the car was never registered there?!

I've search the forum but can't find a case where parkingeye have used an old address that the car was never registered at. I've got no idea where they would have got the details from?

Now I'm assuming when the set aside hearing comes my DVLA documents should be enough and that I should get a refund of my £255 to boot. But this is clearly out or order from parking eye and has caused stress and wasted hours….anyone ever managed to claim compensation for this and how would you go about it?

    there are hundreds of similar ones, plus there was a class action started earlier this year which you should register with

    parking prankster blogged about it

    and the "set aside" costing £255 has been detailed dozens of times on here too

    use the forum search box to find them , especially "credit clamping" like yours is

    and complain to Teresa May in writing as this came up recently too

    fill in the followeng and POST it off , put in a date shortly before the parking avent and a date shortly after the court event , this will state how many times and WHEN they accessed the DVLA datobase

    please note that thier sister company equifax are often used to trace people , and often get it wrong

    just spotted that

    PE have used equita to do a trace , and as usual have cocked it up .

    after you have recieved a reply to my suggested letter , armed with that AND the details you have from the DVLA and put those to the judge , let him ask PE how they found the "correct" address to send court papers to

    You might be able to get the £255 refunded if the Judge is on your side and orders PE to do this, since they used an address that was not the right one (neither your current address nor the one the car was ever registered to).

    But your main task at the set aside hearing will be to convince the Judge that you have reasonable grounds for succeeding in defending the actual claim. If this was very similar to the Beavis case (overstay in a retail park) that will be an uphill struggle and the Judge will likely want to hear what your defence will be relying upon.     post #51 (if the thread is to be believed which I am unsure). We've had some strange ones recently and 'shenanigans' might be at work. We know parking firms read forum threads, especially if someone points them in the right direction...

    I think you cannot assume you will get a refund up front - but should try hard to show this claim should never have been served to that address, which was unreasonable and has caused you loss of £255 as a result. And be prepared to show your case differs from the Beavis case and what your defence will be.

    Do you know which location is alleged and the contravention? Do you know anything at all about the PCN?
