car accident who is liable?

    If you fail to stop in time when a hazard occurs, you've only really got yourself to blame.

    Car B was either going too fast or driving too close to the parked cars, one or the other.

    If you really believe this you would not be moving everything is a potential hazard.
    I was taught that you should always be able to stop within the distance you can see.

    If car A reversed out into the road then car A is the one at fault.

    Assume Car B was travelling within speed limit then there is no way car B can be at fault. Car A must use care and diligence before moving into road (mirror, signal, manouvre).

    A reversing car must always give way to other cars which are travelling in their due course.

    So, car A is at fault.
    Happiness is buying an item and then not checking its price after a month to discover it was reduced further.

    So car ''B'' being driven by a boy racer at 70 mph as I ease out gently at < 5 mph....it's my fault?
  • yep, you pulled out into the road without looking and having an understanding of the road. Although even a boy racer doing 70 will be able to swing round you if you're only doing 5mph.

    Morally, no it should be shared blame.
    Practically, you are likely to take the full blame.

    Simple fact is, you cannot prove the boy racers speed. It is a subjective thing. If 10 people watched said boy racer, you would get 10 differing opinions as to his speed.
    Plus, speed in itself is not an indication of liability. Speed will make an accident more severe but speed alone is not sufficient to cause an accident. In this case, it would be your failure to heed other road users when emerging.

    I did look....twice!...70mph....100feet+/second....I didn't expect that in a 30mph zone (44feet/second) whilst reversing gently...
  • I think the impact damage/braking marks will prove who was in the wrong?
