KeithP - thanks for your reply.
I have actually tried searching the forums but I can't see anyone that's managed to post a copy of a letter that matches mine. I've tried searching for BW Legal and then searching the posts for "http" to see if anyone has posted a link to a scanned copy of their letter. I've also tried searching for "rare" words from their letter like "BW Legal portal" or "BW Legal pre-action" but again I couldn't find any copies of letters. Apologies if I have missed an obvious one.
The letter I received does say "... we will seek Our Client's instructions to commence legal proceedings against you in the form of a County Court Claim Form in the County Court, which may result in you receiving a Letter of Claim pursuant to the Pre-action Protocol for Debt Claims as contained within the Civil Procedure Rules".
I assume that since they're threatening me with a Letter of Claim that I should treat their current letter as a LBC?0 -
...which may result in you receiving a Letter of Claim...
It tells me quite clearly that the letter you have received is not a Letter of Claim.
My understanding is a Letter Before Claim is the same as a Letter of Claim.
Just words to confuse others.
In my opinion, that letter does not warrant a reply.0 -
I don't disagree but if he wants to, it looks reasonable later of they try court.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

ok so since there seems to be a slight differing of opinions as to whether I should reply or not, just wondering if anyone else wants to weigh in?0

It's up to you.
No point having a poll!! (Don't see any differing opinions here)0 -
If it's not a formal LBC it doesn't require a formal response, but it will do no harm (may be seen by a court as being more than reasonable) to do so.
Just do whatever you think is 'right' for you. Neither position is 'wrong'.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
