Hi, the driver is hoping to get some advice on a PCN received by PARKDIRECTUK. In Nov this month @ XX:01 the driver entered the site as the driver needed to turn the car around. Once the driver entered the site, a light on the car came on indicating the vehicle needed Oil so the driver stopped (engine still running) to check, whilst checking, the driver also received a call at the same time ...
the driver has now received a PCN from this company called PARKDIRECTUK demanding paymwent of 60GBP or 100GBP if paid within 14 days. In total the driver was at this site from XX:01 to XX:03 so around 2 mins.
the driver is hoping to establish grounds the appeal should be made on and would appreciate a copy of correspondence that has been successful previously
Thanks in advance

Stopped for 2 minutes, as photos confirm, to check terms and conditions. Decided against parking and left, in accordance with IPC Code of Practice
"15. Grace Periods
15.1 Drivers should be allowed a sufficient amount of time to park and read any signs so they may make an informed decision as to whether or not to remain on the site.
15.2 Drivers should be allowed a sufficient amount of time to leave a site after a pre-paid or permitted period of parking has expired"0 -
First of all, edit your post so that you do not reveal who was driving. Refer only to The Driver, or The Keeper.
Parking companies read these fora.
Next, read the Sticky thread for NEWBIES then send the IPC template letter you will find there.
Spend some time reading up on how this unregulated scam industry.

The IPC template is in black in the NEWBIES thread. No offence meant but you need to learn how to navigate the forum.I married my cousin. I had to...I don't have a sister.

Try the following from post #3.Next, read the Sticky thread for NEWBIES then send the IPC template letter you will find there. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

You don't need the template. In fact IPC cases rarely if ever win at the IAS.
But you have a simple, one point winning appeal if you quote the reference to the code of conduct I gave you in post #2 and keep it simple to that point.
If they turn that down, then they will need to say why and they have no place to run.
That is, of course, if your post is being 100% accurate and not hiding anything.0 -
Yes, that would be fine as a first appeal, I agree with Guys Dad. The templates are there for those who can't think what to say/can't manage to write something without giving away the driver.
Personally, I hate templates in fact, and resisted them for years here - but in the end I was forced to write some because of the number of posters who really did, day in day out, seem incapable of phrasing a few lines without saying who was driving.
That is not everyone! And Guy's Dad's suggestion is spot on.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
