Advise please

I parked in a car park in Newcastle city centre without paying as for as long as I have know that car park it has always been free after 5pm. This had apparently changed but I was unaware until I came back with the fine on my window.

I did not pay and am now on my 3rd letter from the VCS threatening me with court action. I have been told not to pay but have also been scared into thinking they may end up sending balifs out.

They are asking for £100. Where do I go from here?

its either pay up or ignore

VCS (or their agents BW LEGAL) have 6 years to try a court case (MCOL)

and its an INVOICE , not a "fine"

no , they will pass it to somebody like BW LEGAL before the 6 years is up

the court claim is statute barred after 6 years , so they may stop after 6 years, but I would expect a court case long before that , as they have a fish on the hook that they baited previously

I hope you have not used your real name as your username otherwise the parking scammers now know who was driving. You should edit your post immediately to refer only to The Driver.

It is not a fine.

The advice to ignore has not been given since the law changed in 2012.

There is nothing stopping you from making a late appeal. It will be rejected but at least it will go in your favour if the keeper needs to defend this in court.

Bailiffs can't come to your door unless you lose a court case and don't pay afterwards.

This hasn't happened yet.

If you move in the next six years you will need to inform the scammers of your new address.

No, but you are not going to support this scam by paying, are you? You are not going to fund the next PCNs against the next victims, having come here and found out how to deal with this rubbish. We help people see these off.

How do you think that can happen then? Surely you've Googled it and learnt that can't occur without the small matter of you LOSING in court first, then refusing to pay within 30 days of a Judge telling you to pay? Not very likely, I'm sure you will agree.

Anyone who loses against VCS right now that they are using BW Legal...hasn't defended it well. I believe anyone can win these cases with the right information and evidence, as long as they do not say who was driving.

Be ready for a BW Legal letter - that is one to reply to. You can find umpteen examples on the forum every week.
