POPLA - can this ruling be right?

I got a parking charge for parking in my own space on the driveway of our block of flats. I was not displaying my new permit. The old one was on there. I had not got around to putting in on the windscreen.
So i get a parking charge from UKPC. Its issued to the wrong registration plate. Its my reg plate with 1 wrong digit.
I bring this to the attention of UKPC and they reduce the charge to £15.
But i'm like no you got it wrong, the PCN is invalid, i'm not paying you even £15 and make an appeal through POPLA.
POPLA uphold the parking charge and deem it reasonable even though they issued it to the wrong reg plate.
Now i have to pay £101.50!!

I'm no expert but surely if you issue a PCN to the wrong reg plate then that is not a valid PCN.
Accordingly to POPLA its perfectly fine.

I'm gobsmacked!

I basically have no choice now put to pay up ...£101.50 for parking in my own space outside my apartment block!

Are POPLA actually independent and legitimate?
This ruling leads me to suspect otherwise.
Incredulous.

    If they know the driver the wrong reg is immaterial. If they don't and are/were chasing the keeper it's fatal.

    If you went to court then the case would be decided by the contents of your lease or the signs.

    What points did you base your POPLA appeal on? Unclear signage? No authority from landowner? Terms of lease?

    what a pity you complained to UKPC , would have been fun matching the ticket to the NTK

    £101.50 is an illigal sum to ask for , why is it that figure?

    you do not have to pay a penny unless a judge says so

    POPLA is not binding on you, you have the right to defend yourself in court, so do so

    there have been many cases won by tenants or leaseholders etc when it comes to parking in your own space allocated to your own flat or house or apartment

    POPLA can and do get it wrong

    My appeal was very simply based on my permit falling in the foot well (i.e i had a valid permit but it had come off and (2) which i thought was a straight forward case of the PCN being invalid....it was issued to the wrong reg plate.

    POPLA felt neither were admissible.

    I can't understand how a PCN issued to an incorrect reg plate is not invaild!?

    I pursued the POPLA appeal thinking it was a stonewall invalid PCN.
    Now you are suggesting i pursue through the courts??!
    Any idea how much that will cost?

    your blunder was appealing to them , had they have idssued a NTK with the correct number you would have won!

    Yes the not insigniicant sum of £101.50 is deemed a reasonable charge by UKPC and POPLA indirectly.
    UKPC offered to settle the case for £15 when i raised the issue of the reg plate being incorrect but i wasn't paying them a penny for their mistake. I thought i had a no lose case. Not according to POPLA! The offer of £15 even shows their culpability. On UKPC letter regarding their offer of settlement they stated that if you appeal through POPLA and lose you owe us a ton basically!

    Seems completely unfair to me.
  • Please check your lease to see what it says about parking, any lease that shows you are entitled to park is important.
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.
