House buying legal documents

I never received a copy of my purchase contract (signed or unsigned) following completion of my house purchase. The solicitor says they were not required to provide a copy of this document as part of the purchase process documentation. Is this right? They now want £42 from me to get the paperwork out of storage.

    Depends what your contract with the solicitor says, but typically the contracts are not provided as standard (ie there is no legal requirement for them to do so)

    Is there some disagreement over what it contains, or did you just want it for posterity?

    The contract has been fulfilled - you've purchased the property. The contract itself is not the primary record of what you've purchased - that's the LR registration. If that records correctly what you thought you were buying, does the contract add anything?
  • I'm in dispute with the builders and they keep quoting clauses and sections of the contract, but I can't respond as I don't have a copy to refer to.

    Ask them for a copy?

    (and/or ask your solicitors how they justify £42 - I've never encountered solicitors making that sort of charge unless there's a significant amount of photocopying/scanning/postage involved - it ought to involve no more than emailing you a pdf)
  • I've asked for a copy, but they said they need the £42 fee to get the papers out of storage. They also don't have an electronic copy, just the hard copy file in storage.
  • Personally, I'd want to get all the original documents myself rather than leaving them with the solicitors.

    You could ask the builders for a copy of the contract if they are quoting from it. Otherwise you may need to pay the £42.

    It's likely that the sale contract itself is fairly standard - even for a new build, which I presume this is.

    What's the actual dispute, and what are they quoting to you?
