Good Morning,
I received my first ever PCN on Wednesday 16th November. Like a fool because I am new to this world I appealed via email immediately. The reason for the fine was because the ticket want displayed correctly. I could kick myself as I brought it but it must have blown face down when I shut the door. The have rejected my appeal and have photographic evidence of the ticket being upside down. Is there anything I can do now or is it too late as I emailed referring to me as receiving the fine!! Thanks alot all. Gemma

Are Elite in the BPA still, they used to be sooo easy to beat at POPLA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Certainly. Start by reading post #3 of the NEWBIES thread where there is advice about POPLA appeals and templates to put together, you can literally copy them and make a long appeal. Someone posting today just won at POPLA (the PPC gave up) and used just 3 template appeal points from here. Another person who was pushed for time, reported winning after just bunging in the 'War & Peace style' signage demolition job template.
I would be amazed if 'we' lose v Elite! You have 28 days to use the POPLA code from the rejection letter date, so plenty of time?
You DO NOT need to check on any 'code checker' so please no posts about that.
We have previous POPLA appeals arguing that a 'fluttering ticket' is not reason for an unconscionable penalty. In fact I recall a POPLA appeal the other month where we tried including information about the concept of 'fluttering tickets' from Council Lead Adjudicator Report and arguing that this was the same issue.
Someone has also just won in court with a Judge who said it's up to the parking firm to provide a robust/sticky P&D ticket fit for purpose. See the Parking Prankster's Blog from this month for that one - use it.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
