Parkingeye Popla appeal help plz!

I have read the newbie posts but am not sure if it would be worth me appealing. I am not sure which template I could use because I have already identified myself as the driver (and I think I may have said I was aware of the 3 hours limit as I have parked there before).


Background:


I parked at Woodfields retail park at Bury on 6 Aug which had 3hrs free parking. After shopping I returned to my car but it would not start (thought it was a flat battery at first but turned out to be a problem with the starter motor). I called my partner (who drove down and got the car running again for me) but by the time we left I had overstayed by 15mins.
I appealed to Parkingeye explaining I was aware of the free parking limit but it was exceptional circumstances and not a deliberate failure to leave within the set time and included a receipt from one of the shops on the retail park (the only one I had kept, didn't keep the McDonalds or Tesco receipts). They responded asking me to provide further proofs. I resent the one receipt I had and stated again this was the only receipt I had kept.
The last letter from Parkingeye stated that:
"You have provided evidence of purchase. However, pleased be advised that this did not meet the discretionary criteria set by the landowner in this case. We are therefore writing to advise you that your recent appeal has been unsuccessful and that you have now reached the end of our internal appeals procedure. This is because you have not provided sufficient evidence to show that you did not break the terms and conditions on the signage."


Was jut going to pay the fine but each time I go to pay it frustrates me as it is so unfair. If I am going to appeal to Popla I need to submit this today as the last letter from Parking eye was dated 21 October and it says I need to appeal within 28 days of the operators notice of rejection.


Any help/advice would be appreciated. Otherwise I guess I will just have to pay up :(

  • You *DEFINITELY* appeal this to POPLA.

    Do some forum searches for "parking eye", "Popla", "breakdown" and other relevant terms, and you'll find a few appeals on the same basis.

    As much as anything else, it's worth pointing out that at 15 mins you haven't exceeded the minimum grace period times in the CoP - the ANPR camera will be at the entrance/exit, so won't have recorded the time spent parked, just the time beyond the cameras.

    You've got a bit of work to do, but you will almost certainly win this on grace periods and the breakdown.
