no fault claim

Hi,

I was involved in an accident yesterday. Its no fault as the other car ran into me. When I reported it, the insurance asked me had I any accidents in the last 5 years. I said only a no fault one 3 years ago.
They said this wasnt on file - so I assumed I had it wrong and said it must have been longer as I would have declared it.
I've now checked .. and I have had a no fault accident 3 1/2 years ago!! I've looked at the policy and have not declared it (I don't no why - the only thing I can think of is that it was because I read it as a claim and not any claim inc no fault!)
Where do i stand? I'm very worried as although its a no fault accident (the other party admitted this at the scene) then what happens and what if they changed there mind and challenged (they drove into me!!)

They may consider you were deliberately withholding information. This is the danger of not declaring.

You are required to declare ALL accidents whether your fault or not.

  • I realise that now ... which is obviously not great!
I wasn't withholding but obviously it may look like that.
I feel I should tell them but am very worried in terms of this current incident ... which is no fault but I assume they will now check history etc?
Would they not have done this previously (when I took the policy?)

When taking out the policy you will have confirmed you told the truth on your application and in turn the insurer will have confirmed back to you what you told them about your history, asking you to check the documents.

Now that you have been 'found out' just confirm now the circs of the claim.

Whatever action your insurer takes there is no need to worry about the current incident as you say you were blameless.

So there will be no claims against you, and you don't need to claim off your own policy but can claim off the third party insurer (should your insurer take the view you lied on purpose to keep your premium lower and take action against you eg cancellation of your policy)

    Not necessarily .

I had a no fault earlier this year, but in the car of which my husband is first driver. When he came to renew, they wanted to add 25%, even though they were not involved in the claim (other party admitted liability and their insurer dealt directly with us), but he got them down to a couple of pounds (the quote was still very good).

Last month , my husband renewed the insurance on the other car and, though the broker knew of my accident, when forms came for signing, the box asking about claims/accidents was ticked as none. My husband rang, the brokers, who suggested filling in the details and returning the form. The policy price stayed the same.
