  • If you really want to, as you're in Scotland (i assume you both live there and the Wickes was there?) - then you can contact them, and be much much much more forthright and bolshy.

    Point out to them that POFA2012 doesn't apply in Scotland, and is only the law in England and Wales. Point out to them that, as such, the Scottish Government has rejected the transfer of liability from the driver to the Registered Keeper for any pseudo-contractual mumbo-jumbo related to private parking.

    The point out to them that, as the incident occurred in Scotland, they had no right or reasonable cause to request your data from DVLA as they (should) know full-well that incidents in Scotland are unenforceable on the RK in the same was as in England and Wales. Further point out that you consider this a misappropriation and a misuse of your personal data which has been illegally accessed, and that as such, if they do not immediately (within 7 days) cancel the charge and confirm deletion of your data, you'll be pursuing them for damages. Then tell them any further correspondence will be treated as harassment now they have been informed of all the above.

    If you want to be that bolshy of course.

    And yes - if Wickes are going to sanction such activities in the first place, and then double-down on the illegality by allowing it in Scotland where harassing the RK isn't enshrined in law - do you really want to give them your money?

    Find a local kitchen fitter instead.
  • Goodness me, they are such pirates! I didn't realise all of this and thank you for helping me out. I will have a think about being bolshy, because I'm not very good at it - I'm one of the ones who gets unnecessarily frightened by their letters! But I do know I won't be shopping at Wickes again if they are happy to let this happen to their loyal customers. And you're correct, definitely no kitchen from them.

    If you are frightened by the debt collector letters just search this forum for them (e.g. put 'Debt Recovery Plus' into the forum search box for 'this board') or read post #4 of the NEWBIES thread which tells you about ignoring debt collectors.

    You can also search the board for 'Scotland debt collector' which would be my recommended key words for this parking forum, to read threads like yours. Nothing happens but the letters.

    Personally I would ignore G24 as you are in Scotland, not even prodding the snakes nest at all. Oh, and G24 never sue anyone in England either but in Scotland they have no chance and no case against a keeper. NEVER say who was driving.

    I would however, email Wickes Head Office and post something about this major complaint on their FB page and Twitter. Social Media complaints work wonders. Again, just say 'we' so as not to suggest which of you in the car might have been the driver. The reason to continue to escalate the complaint is the amount of success we've had with Wickes cancelling G24 PCNs (all the time). Which spares you the threatograms!

    Probably the best course of action to be fair - but as you know G24 and I have a bit of previous and so I personally would enjoy the opportunity to take them to the cleaners.
