POPLA Appeal - own space
Pleaseadviseme
Hiya,
I hope someone can advise me on whether or not to pursue a POPLA decision.
I received a PCN when parked in my own space which is numbered as reserved for my flat. I had forgotten to display my permit.
I appealed to the parking company in question on the grounds that it was my space to which I deserve quiet enjoyment, the charge was unreasonable, the fine was not being passed to the landowner or my landlord and they did not have a right to it.
My appeal has been rejected. I did not mention the driver in the appeal letter, however, the email back from the company has me listed as the driver and registered keeper, so I'm unsure if a drop down box slope to show the wrong answer unbeknownst to me, would it be worthwhile going back to them on this?
The car park is a secre locked car park accessible only to residents with two electronic gates plus 24 he security to get through, so I find it wholly unjustifiable that there is such a risk of unauthorised parking that this company has got involved.
Please advise me on the appeal and whether or not you think I can get this reversed - the fine is £100, which I am really upset to pay to park in my own space.
I have checked my lease agreement, which does not mention the space or any Peking restrictions, however, have written confirmation from the letting agent (who manages the property) that the space is conveyed as part of my agreement.
Please advise me, I can attach a copy of my previous appeal if this would be useful

You can consider going on the attack like this:

And re POPLA, start by reading post #3 of the NEWBIES thread here on MSE on page one of this board, which has template appeal points. You can use several, including (but not limited to) the ones about permit car parks. Newly added is the wording about the Jopson case and how that can apply to 'own space' car parks (and employer permit car parks).
The wording for the points you need is already written, just needs tweaking. The templates are deliberately long.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
