Paying For Funeral

My father in law passed away, my mother in law has early signs dementia short term memory loss, and never leaves the house, keeps forgeting he has passed away. The only account she has is a bulding society book. She asked us to arrange the funeral which we have but how do we pay for it. I asked advise on here before and was told to take the funeral bill to the building society and they would write a cheque coming from my father in laws estate. But as we have no legal power of attorney and just trying to do the best for mum, if we were to go ahead and take it from my father in laws estate are we breaking the law. My wifes close to breaking point now this is a nightmare.

The estate is liable but having arranged the funeral you could be as well. Go and ask the BS ASAP.My father in law passed away, my mother in law has early signs dementia short term memory loss, and never leaves the house, keeps forgeting he has passed away. Did your FIL have any bank accounts?
If the BS account is in Mum's name, they won't give you a cheque unless mum authorises it, and probably not then without her being present. They might be willing to do it is she signs the necessary withdrawal form.
Can you talk to your MIL about her granting Power of Attorney? Or if she won't do that, adding your spouse as a joint account holder so that you spouse can deal directly with the bank / building society.
What assets dis FIL have? All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0 -
Just speak to the Building Society. Please don't rely on opinions and (often poor) advice on here.0
