Help with PCN from Ace Security Services

Sorry if the answer to my questions is already somewhere else in the forum, but I've gotten quite confused with all the information on here.

At the end of September this year, I received TWO PCNs from Ace Security for parking without a valid permit.

I own my property and had just acquired a new car. I was parked in a street behind my house. There are signs to tell you that you require a resident's permit or a valid visitor's permit to park there. I had tried to apply for a resident's permit at the council office before getting the car but as I did not have the logbook in my name yet, they told me I could not apply. So I bought a visitor permit in the meantime. The visitor permit is one of those with 10 boxes, requiring you to put a date in the box for each 24 hour period you use it. Unfortunately, on the two occasions I forgot to go and update the permit, I got slapped with PCNs (£60 each). I must say that there were plenty of empty boxes on the permit, I merely forgot to put a date on it. The reason I didn't fill it all out was because I was expecting the logbook to come in any day and I could quickly go to get my resident's permit on the same day.

I have never received a PCN from a private company before and was advised by friends to ignore them.

Unfortunately, last week, I received NTK from ACE.

I probably should have appealed against the PCN to explain the situation as I feel it is unfair that I should have been penalised when I did have a visitor permit on display (just not updated).

In any case, I am unsure what I should do now and would really appreciate some advice. I don't think I should ignore any more.

Is the road you parked on part of the Local Authority maintained highway? You've mentioned the council issuing permits.

    Check with your Council.

Meantime read the NEWBIES FAQ sticky to start you off in the right direction on this.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Follow the advice in the newbies faq thread

(You can still appeal as the keeper but don't admit to being the driver - edit the op to remove details of the driver's id)

Yes, I believe it is a local authority maintained highway. We can park there as homeowners but need to purchase a resident's permit from the local authority.

I have read the newbies FAQ. So I understand I should appeal the NTK. I'm wondering if I should use that generic one on the forum (for IPC members) or whether I should actually just argue about how I did have a visitor's permit and merely forgot to update? The generic template doesn't really seem to explain to the company why I feel the charge is excessive and uncalled for.
  • OK, I've now been told that the road is a private parking area for residents.
