PCN Yellow Box Junction

Hell everyone


I have received 2 PCN for Kinsgton in quick succession, different YBJs too. First one my back 2 tryres were in the the YBJ so particularly annoyed with that one.


My question is about a technicality on the PCN itself.


It is worded:


"The Royal Borough of Kingston upon Thames believes you are liable to pay a Penalty Charge with respect to the above vehicle, for the following alleged contravention: 31 : Entering and stopping in a box junction when prohibited"

But they have given what I have contravened, Contravention 31 of what exactly. I know through other forums that it is of the Highway Code, but given that the Highway Code is not legally binding shouldn't they also give reference to the statute which I believe is The Traffic Signs Regulations and General Directions 2002 and the Road Traffic Act.


Could this amount to the PCN not being correct and gives me the possibility to appeal

    but if the photograph proves you are in the box then you are unlikely to win an appeal

    As above, pepipoo are the council/police motoring experts whereas we specialise in private parking tickets here.

    However, as far as he code is concerned, somewhere there will be a list of contravention codes. These may or may not anything to do with the highway code or road traffic act. You may be able to find these on the PCN or the council website.

    There should be CCTV/images available for you to view. Without seeing them it's almost impossible to pass an opinion.

    Entering the box junction isn't actually the offence, it's stopping within it which completes the process. The only exemption is when turning right and being prevented from doing so by on-coming traffic.
