eBay dispute - seller threatening small claims court

Thank you Bris for your comment. The dress was delivered Thursday morning to my fianc!'s work. He brought it home that evening. I contacted the seller half an hour later after examining the dress thoroughly and taking photos. It was a wedding dress so I can guarantee that the item was not used by me and then a claim opened after the "big night" or in this case wedding! I am an honest buyer and seller who has been a member of eBay since 2009 and has 100% feedback on hundreds of items. In this instance it is the seller who is the fraudster.0

If she had a video, she would have mentioned this beforehand rather than offer £50. I would just let ebay deal with it, she would not bother with threats of SCC action should would just follow procedure rather than get emotional. How threatening are these?0

As a couple of people have pointed out..
If she genuinely thinks the item was undamaged, and has video evidence to prove it.. then no way would she have offered a £50 refund.
She knows it was damaged and is now trying to scare you with threats of court action. Stick to your guns. Don't give her an inch.0 -
Shes taking nonsense, Ignore any further threats, but don't be surprised if a fake letter from a solicitor arrives, it happened to me, it was shredded, ignored and they went away,0

Ask yourself the question,
If she was telling the truth and it was sent undamaged
IF you are telling the truth and it arrived damaged
Then it was damaged in transit, So why would she threaten court instead of taking it up with the carrier, Shes 100% lying and knew it was damaged.0 -
The box was in perfect condition. Def not damaged in transit. The holes are all around the bottom of the dress (made of lace) as if it has caught on heels of shoes or something. But def not from transit. This is putting me off eBay. I have been buying and selling since 2009 and have never had an experience like this. So worried.0
