CCJ paid within 30 days

We attempted to sell our house through an estate agent, they were supposed to set up a direct debit for us to pay the fees for this. They never did despite my numerous requests for them to do it. Eventually they contacted us saying we owed them the £2500 and they wanted it paid now. We explained we were still waiting for the direct debit to be set up. After a while of this they agreed we pay them £100 per month through standing order not direct debit. We came to the end of the payment and that was the end of it. Or so we thought.
Fast forward a few months of never hearing from them and we get sheriff court officers at our door saying they have raised a CCJ against us and we need to pay or attend court. The amount we miss paid by was £30 and they had added an extra court fees of £345 on top. It was a genuine mistake to under pay them by £30. If they had sent us a letter or called us we would have paid it right away. Anyway we paid the £30 immediately to them and they said we did not need to pay the £345.
Now the problem I have is this CCJ is still on my credit file. It is marked as satisfied but I feel it should be removed as I paid well within the 30 days. The court said I need a letter from the estate agent confirming I paid etc. The estate agent has agreed I've paid and said they will send the letter but they never do. This has been going on for nearly a year and they have started to just ignore me. I don't know what else I can do?

Hi
Use the estate agent’s own complaints process initially if you haven’t already done so. You can then escalate your complaint to the Property Ombudsman. It looks like Slater, Hogg and Howison are a member.

Your post is very odd.
Firstly, a CCJ is a County Court Judgement. There are no County Courts in Scotland.
Secondly, are you suggesting that the estate agent didn't write to you and obtained a Decree (not a CCJ) all without your knowledge.
Thirdly, you've been had as their costs would have negligible for a £35 court claim.
Finally, they were either giving you a glorified letter or small claims court summons. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -
Hi,
Thanks very much for your replies.
It definitely says County Court Judgment on my credit report. I still have all the paperwork and it says it all over that as well.
I didn't receive any request for outstanding monies from them, obviously if I had i would have just paid it as it was only £30!
Thanks again.0
