declined for mortgage because credit file hasnt updated

Hi

Im desperately seeking some guidance. please help if you can
My girlfriend and i have just applied for a mortgage and both have excellent credit ratings, but to our shock we were declined for a CCJ that was appearing that was linked to my girlfriends credit file due to her ex boyfriend of 4/5 years ago.
We have disassociated from his name and previous addresses which we understand to be the correct process, but despite all assurances from experian to say our credit file is COMPLETELY CLEAR, we have continued to be declined for a mortgage because the CCJ is still showing up.
we are about to lose our dream house unless we can tell the estate agent when we can reapply and and be accepted, but we cant seem to find this out.
does anyone have any knowledge of how long it will take or where i can get some info on getting this CCJ and association removed from our credit report? its simply not fair to hold this against us when neither of us have ever missed a payment in our lives, yet we are being held to account for someone else's actions that we cants seem to shift from or records despite experian telling us this is the case.
early answers would be very much appreciated.

thanks

Is the CCJ in her name? Is it in respect of a joint account? If it is solely in his name and they no longer have any joint accounts then dissasociating should do the trick.

You need to try all three credit reference agencies. Get a statutory report from each for £2 and if there is still an association on any of them then ask them to dissasociate. That would also show any other details which might be worrying a mortgage lender.
  • Hi
the CCJ isn't in her name and she didn't even know about it until it flagged up.
the problem is that she has now disassociated, but despite Experian claiming her file is now clean of the CCJ and association, we are still being declined for our mortgage because of it. clearly the mortgage compay are seeing a version of the credit report which no longer exists, but they are adamant that it is a live time view, where as Experian are adamant that the live view is clean.
in the meantime we are about to lose this house.
    any help or advice?
we did hear that it takes between 4-6 weeks for some things to be removed from your file, but that would contradict having a clean report. we are stuck because the system is broken, but don't know how to solve it
  • Have you checked all three of her files?
  • yes. the disassociation has been applied for all 3 credit agencies. we have excellent credit rating for all 3 yet the CCJ of her ex partner is still popping up on a mortgage application credit check

Get a statutory report for all 3 to see what is actually on there. Submit a complaint to any CRA which still shows an association and tell them it is urgent because you could lose a house.

Edit:- are you using a broker? This is a case where getting someone who knows what they are doing, and has contacts with mortgage companies, on your side could be very important.
