UKPC Court claim question
Comments
-
Unfortunately I don't know if the Judge erred at all. The only things I can think of that raise questions are:
- That the Judge allowed their solicitor to use their laptop to go online to fine evidence that was not previously submitted (the section of the POFA 2012 which allowed them to pass the fines on to the registered keeper),
- That the Judge seemed to think it was perfectly valid that the timestamp on the evidence photos didn't match the lack of darkness as the time settings may have been wrong but this did not mean that it was not possible to accurately determine whether 48hrs had actually elapsed or not
- Even though UKPC were caught manipulating Timestamps around the time of these parking tickets and the timestamps did not match the brightness of the sky, the 2 issues were unrelated as it was a one off incident!
