PPI Company want paying but did not complete the work. i did

good afternoon. I applied for PPI through a company called fast track reclaim. At first I had emails saying that the handler dealing with the case had changed. This happened 3 times. Over 3 years later I decided to aply for PPI myself(this was after not hearing from fast track for around 2 years.) I went direct to the bank and started the claim from scratch. 8 weeks later Irecieved a pay out. This was in august. Yesterday I recieved an invoice requesting 25 percent of my claim from fast track. Should I pay? in my opinion I was abandoned and did all the work myself. your advice in this matter will be greatly appreciated!

    Hi,

    Welcome to MSE.

What on earth where they doing for 3 years ???

That beggars belief, a simple letter of complaint, asking for a refund, is all thats necessary, takes no longer than a couple of months normally, as you, yourself found out.

I would write back and refuse to pay them on the grounds that they took an unacceptably long time to deal with your claim, plus the fact your claims handler was changed on three occasions, they didnt actually do any work on your behalf, in the end you had to make the claim yourself.

(Let this be a warning to you about using claims management companies).

n my opinion I was abandoned and did all the work myself.

    Did you cancel the contract?
Did you receive a cancellation confirmation from the company?

Did the lender confirm the original complaint being received and acted on?

  • I did not recieve anything for around 2 years and didn't cancel as I thought they had given up. I contacted Lloyds and started a new case

IMO despite they taking so long, and the fact that you did not cancel the contract, your obligation to them stands so you will have to pay them 25/30% of claim plus VAT.

How about claiming that the PPI company miss-sold their contract to you??
  • I was thinking of going down the route of breech of contract through abandonment
  • 2.6.1 The law requires that goods should be delivered, and services carried out, when agreed, or, if no date is fixed, within a reasonable time. A term which allows the supplier to fail to meet this requirement upsets the balance of the contract. This applies not just to terms which simply exclude all liability for delay, but also to standard terms allowing unduly long periods for delivery or completion of work, or excessive margins of delay after an agreed date. The effect is the same – to allow the supplier to ignore the convenience of customers, and even verbal commitments as to deadlines.

They have not abandoned anything. Early PPI complaints were taking multiple years.

Irrelevant. You employed a claims company to put a stamp on an envelope containing your complaint. If they did that then they did their job. They are not responsible for the length of time the lender takes to look at the complaint or arrange redress.

    I repeat my earlier question:
Did the lender confirm the original complaint being received?
