Official Ticket

Hi,

There is lots of good advice on this site for dealing with private tickets, does anyone have any advice on whether it is worth appealing an official one from a Council?

I went to a long stay car park on my hols, paid for 24 hours parking, but had not realised I had parked in a bay which was for permit holders only. It was dark when I drove in and did not see or notice a sign which is located near the small area of these type of bays. It also turns out there was a sign painted on the floor at the foot of the bays, though not actually in any of the bays. Once again I hadn't seen the sign, maybe cos it was dark. So I paid nearly 8 pound to park overnight, then went back and paid another amount for another 24 hours, but didn't notice in the daytime as I guess I was not looking for it. The vast majority of the car park is for the public and it just wasn't on my radar that they had a small area for permit holders.

So I not only have now to pay the fine but I also paid about 16 pound for tickets that I basically didn't use as I didn't park in the right bay! Frustrating as the car park was virtually empty, I paid for a ticket and parked only a few metres away from a bay which would have been ok to park in.

Is it worth me appealing or is it a waste of time?

Cheers.

  • I'd suggest reading your post. By your own admission you parked in a bay in which you were not entitled to park, so you were rightly issued with a fine.

You say you didn't see the markings in the car park as you guess you "was not looking for it".

You are aggrieved that not only have you been fined, but you paid for tickets that "I basically didn't use". Rubbish! You parked there - albeit in a bay you weren't permitted to park in.

Get over it! You made a mistake, parked in the wrong bay, but did use the facility for parking and were penalised for your oversight.

In my view a fully valid penalty was issued and I don't see the slightest grounds for appeal.

You will get good advice on appealing "proper" council tickets ( as opposed to the unnecessary sermon above!) at pepipoo.

@OP - ignore post #2, obviously knows nothing about the inside track of this subject, don't know why the poster suddenly jumped in on a parking help forum with no track record on MSE of having any experience in this field.

Usually best received advice on posting 'advice' on something you know SFA about is to !!!!!!, leave it to those who do know, but stick around if interested in knowing more.

@OP - As we tend to major on private parking tickets here, PePiPoo will be your best bet for council tickets. Register there (but please note that a hotmail address won't work) and post a new thread; here's your link:

Have a read through some of the other threads there before you post your own to get the hang of what information they need from you in your opening post - but as a minimum you will need to post redacted photos/scans of all correspondence you've received from the council (both sides, if appropriate) as they need to see all the small print.

PePiPoo has an excellent success record in dealing with council tickets.

Then, when this is over, come back and tell us (and especially Placitasgirl) how PePiPoo sorted this for you!

On this forum we are here to help, not to judge and definitely not to shove gratuitous admonishment down your throat sideways!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
